Reverse Reverse! CTA UPDATE- Preliminary Injunction Reinstated
We provide an update to our previous post "Corporate Transparency Act Enforcement Blocked: What Now?" and the December 23, 2024 news about the Fifth Circuit Court lifting this injunction, reinstating the January 1, 2025, deadline, but FinCEN extended the deadline to January 13, 2025.
On December 26, 2024, the U.S. Court of Appeals for the Fifth Circuit reinstated a nationwide preliminary injunction against the enforcement of the Corporate Transparency Act (CTA). This decision, again, temporarily halts the requirement for businesses to file beneficial ownership information (BOI) reports with the Financial Crimes Enforcement Network (FinCEN). As a result, although beneficial ownership information (“BOI”) reports may be filed with FinCEN, they are not required to be filed pending further court order.

Given the ongoing legal proceedings and potential for further changes, businesses should:
